KVKK Disclosure Text

Prepared by MÜQ ("Data Controller," "Müq") in accordance with the Constitution of the Republic of Turkey, international treaties to which our country is a party regarding human rights, and relevant legislation, especially Law No. 6698 on the Protection of Personal Data ("KVKK," "Law"), this KVKK Disclosure Text ("Disclosure Text") aims to inform you about MÜQ's personal data practices and your rights as a data subject.

The processing of your personal data refers to any operation carried out on data, whether fully or partially automated, or through non-automatic means, including obtaining, recording, storing, preserving, modifying, reorganizing, disclosing, transferring, taking over, making obtainable, or classifying data.

According to KVKK, your Personal Data may only be processed within the scope described in this text by the Data Controller. MÜQ is responsible for determining the purposes and means of processing personal data registered in the database, as well as establishing and managing the data recording system.

In this context, the Data Controller will process your personal data in compliance with the principles specified in Article 4 of the KVKK, which include:

Compliance with the law and fairness,

Accuracy and being up-to-date when necessary,

Processing for specific, clear, and legitimate purposes,

Being relevant, limited, and proportionate to the purposes of processing,

Retention for the period stipulated by the relevant legislation or the necessary duration for the purpose of processing.

Collected Personal Data

As the Data Controller, we process the personal data of our members and service recipients, as specified in this Disclosure Text, to fulfill our obligation to inform. The processed personal data includes identity data, communication data, financial data received for the purpose of carrying out necessary transactions with the bank, digital trace data, and data related to order history.

Method of Collection and Legal Basis for Personal Data

Personal data is collected in electronic form. Personal data collected for the purposes stated in this Disclosure Text can be processed and transferred in accordance with the legal bases specified in Articles 5 and 6 of the Law and the purposes stated in this Disclosure Text.

Purposes

Your personal data is processed by the Data Controller for the following purposes: to ensure the conduct of operational activities necessary for the provision of products and services offered by the Data Controller, to understand your needs by getting to know you better and recommend products and services suitable for your consumption and purchasing motivation, to inform you about our products and services, to measure your satisfaction with our products and services, to improve and diversify our products and services in line with your requests and needs, to take necessary quality and standard controls, and to make commercial decisions and implement them. Additionally, personal data may be processed for reporting and other obligations stipulated by legislation.

Legal Grounds

Your personal data may be processed without requiring explicit consent, in accordance with the conditions specified in the Law, based on the following legal grounds:

a) Explicitly prescribed by the laws,

b) Being mandatory for the protection of life or physical integrity of the person who is unable to express his/her consent due to actual impossibility or whose consent is not legally valid,

c) Being directly related to the conclusion or performance of a contract, provided that it is directly related to the parties of the contract,

ç) Being necessary for the Data Controller to fulfill its legal obligations,

d) Being made public by the data subject himself/herself,

e) Being necessary for the establishment, exercise, or protection of a right,

f) Being mandatory for the legitimate interests of the Data Controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

Storage of Personal Data

The data, especially processed for the execution of service procurement processes, contract management, customer satisfaction, fulfillment of accounting transactions, and security purposes, are stored, and if there is no legitimate purpose for their retention after the end of the underlying contractual relationship, they are deleted or destroyed. However, data that may need to be retained as evidence in possible commercial disputes are kept at MÜQ during the legal statute of limitations.

Transfer of Personal Data

Your personal data may be transferred to our business partners, banks, legally authorized public institutions and private individuals in accordance with the personal data processing conditions and purposes specified in Articles 8 and 9 of the KVKK, for the legal and commercial security of MÜQ and individuals in business relations with MÜQ, to carry out the necessary studies to benefit you from our products and services, to fulfill the requirements of our service, to personalize products and services according to preferences, usage habits, and needs, and to determine and implement commercial and business strategies, as well as to fulfill legal obligations.

Rights as a Data Subject

As data subjects, you have the following rights:

Learning whether personal data is processed,

Requesting information if personal data has been processed,

Learning the purpose of processing personal data and whether they are used for their intended purpose,

Knowing the third parties to whom personal data is transferred, domestically or internationally,

Requesting correction of personal data if it is incomplete or incorrectly processed and notifying third parties to whom personal data has been transferred,

Requesting the deletion or destruction of personal data within the framework of the conditions stipulated by the law, despite being processed in accordance with the Law and other related laws, and notifying third parties to whom personal data has been transferred,

Objecting to the occurrence of a result against the individual by analyzing the processed data exclusively through automated systems,

If personal data is processed unlawfully and causes harm to the data subject, demanding the compensation of the damages.

In accordance with Article 13 of the KVKK, you can submit your requests regarding the use of the specified rights to the Data Controller in writing or through other methods determined by the Personal Data Protection Board.

To exercise your rights, you can personally submit your request with the necessary information identifying your identity, address, and contact information, along with explanations regarding the right you want to exercise, to the address: Acıbadem Mah. Çeçen Sokak Akasya Evleri Sitesi A Kule Blok Apt. No: 25 A/63 Üsküdar / Istanbul, or you can send it via notary or other methods specified in the KVKK.
